SPOUSAL MAINTENANCE Maintenance or “alimony” is financial support paid by one spouse to the other. Both the husband or wife may be entitled to receive spousal maintenance depending on their financial need and the other spouse’s ability to pay. When assessing the need or amount for spousal maintenance, Courts consider many factors, some of which include the length and standard of living of the marriage, the ability of the spouse requesting maintenance to be self supporting, the time it would take for one spouse to “rehabilitate” (i.e. by education or job search etc.) to become self supporting. Each case is unique. Therefore, whether you feel that you are entitled to receive spousal maintenance or whether you feel that you may be obligated to pay, you should seek legal advice to determine and protect your rights. |
