PATERNITY Paternity involves the adjudication of a father as the biological father of a child or children and generally involves unmarried parents. The adjudication process may involve genetic testing when paternity is questioned or disputed. Paternity is presumed when the father signs a Recognition of Parentage, is listed as father on the child’s birth certificate, or when the father “holds the child out as his own” by living with and caring for the child. Even with these presumptions, the father of a child born out of wedlock has no “legal rights” to the child until an appropriate custody proceeding has been commenced and custody and parenting time are determined by the court, whether by order or stipulation. |
