Attorney Chuck Ramsay has finished the end of the year the same way he began – by having criminal sexual charges dismissed against his client. In both cases his client was falsely accused.
Ramsay's client, LM, is a reputable professional in the Twin Cities. He was accused in July, 2006 of having sex with a woman without her consent. While LM did not contest he had engaged in sexual relations with the woman, he disputed her claim that he had committed "date rape" by having sex with her while she was sleeping.
LM hired Ramsay to protect his reputation and to prove his innocence. Ramsay immediately went to work on the case. He had his private investigator check into the background of the alleged victim. Together, Ramsay and his investigator interviewed witnesses who gave valuable information in LM’s defense. Ramsay also used his subpoena power to obtain phone records which he used to show that the victim's story was not credible. Ramsay soon developed a theme which, when discovered by the Ramsey County prosecutor, made it clear that the state would not prevail at trial. On December 18, 2006 – the day trial was scheduled to commence – the prosecutor dismissed the case.
Had LM been convicted, he would have faced a maximum of ten years in prison and a tremendous loss of reputation. The sentencing guidelines called for a 48 month prison sentence. LM would have been deemed a sexual predator and would have had to register with the local police each time he changed his residence.
Ramsay intends to have LM’s arrest – including his booking photograph and fingerprints – expunged from both the courts and the executive agencies (St. Paul Police, Minnesota Bureau of Criminal Apprehension (BCA) and the Federal Bureau of Investigation (FBI)).
